Facts
Joseph Canty (plaintiff) had a checking account with Vermont National Bank (Vermont National) (defendant). Canty paid obligations by check to the Internal Revenue Service (IRS). The IRS later requested that Canty submit canceled checks to document Canty’s payment of those obligations. Canty forwarded the canceled checks, the IRS redeposited the canceled checks, and Vermont National paid the checks a second time from Canty’s account. Canty sued Vermont National and moved for summary judgment.
