Facts
Class-action certification and approval of a proposed settlement was sought in the United States District Court for the Eastern District of Pennsylvania on behalf of persons who had been exposed to asbestos either occupationally or through the occupational exposure of a spouse or household member. The district court granted conditional class certification. Some unnamed members of the putative class who objected to the settlement (objectors) also challenged the standing of class members who had only been exposed to asbestos and never manifested a physical injury or other asbestos-related condition. The objectors specifically alleged that the exposure-only class members lacked Article III standing because they had not sustained an injury in fact.
