Facts
Carpenter and other homeowners (plaintiffs) brought suit against Double R Cattle Company (defendant), contending that Double R’s expansion of its cattle feedlot constituted a nuisance because it caused severe odors, pollution, and noise, negatively affecting the surrounding neighborhood. The trial judge instructed the jury to weigh the alleged harm resulting from the lot against the social utility of the expansion in determining whether the expansion constituted a nuisance. The jury found no nuisance. The homeowners appealed.
