Facts

The Carpenters Local No. 1506 union (defendant) claimed that four construction contractors including Eliason & Knuth of Arizona, Inc. (plaintiff) paid workers substandard wages and benefits. The union used large banners at the contractors’ jobsites that identified their secondary employers and declared a labor dispute. Union representatives held the banners stationary, without chanting or yelling and without blocking entrances. The union also passed out handbills explaining the dispute and that it was not urging workers not to work or suppliers not to deliver. The contractors filed unfair-labor-practice charges, and General Counsel for the National Labor Relations Board (NLRB) found the banners amounted to unlawful secondary picketing.
