Facts
Everette and Patsy Carrigg (plaintiffs) purchased a used Thor Challenger R.V. in an as-is condition and a corresponding three-year service warranty from General R.V. Center, Inc. (General) and Cornerstone United, Inc. (Cornerstone) (defendants). The purchase agreement included specific language disclaiming all express and implied warranties on the R.V., both in full sections and in a fully capitalized and bolded disclaimer statement. The agreement also included an integration clause stating that the written agreement represented the full and final understanding of both parties. During the purchasing process, General’s employees allegedly made statements about the excellent quality of the R.V. and the existence of a manufacturer warranty. The Carriggs eventually discovered that the R.V. had structural and mechanical problems and that the manufacturer warranty had expired two years prior to their purchase. The Carriggs submitted several claims to Cornerstone for repairs, which Cornerstone paid. The Carriggs filed suit in the United States District Court for the Eastern District of Michigan against General and Cornerstone. The Carriggs claimed that General breached the implied warranties inherent in the sale of goods and breached the express warranties its employees gave them during the purchase process. The Carriggs also claimed that Cornerstone breached its service agreement by failing to repair the R.V. General and Cornerstone moved for summary judgment. The district court granted Cornerstone’s motion because Cornerstone paid all claims it received from the Carriggs, in compliance with the service warranty. The district court specifically analyzed the Carriggs’ claims of breach against General.
