Facts
Carter (plaintiff) worked as a housekeeper for the decedent for 10 years before the decedent’s death. Before his death, the decedent said that he loved Carter, wanted her to have all his money, and specifically, wanted to give her $80,000 to purchase a liquor store. The decedent wrote Carter a check for $80,000 and gave it to her. Carter presented the check for payment the next day, after the decedent had passed away. The personal representative of the decedent’s estate, Percy (defendant), did not honor the check. The trial court ordered the estate to pay Carter the $80,000. Percy appealed.
