Caruso v. State
Tennessee Supreme Court
326 S.W.2d 434 (1958)

- Written by Sarah Holley, JD
Facts
An officer reported to a business building after being informed that a robbery was in progress. When the officer entered the building, he noticed that the back door was open, and he heard three men running. The officer also saw a safe just outside an office with a cart against it. According to the facts, the safe weighed about 600 pounds and was left at its usual place inside the office of the business building. Using the cart as an aid, Caruso (defendant) moved the safe a distance of five feet out of the office and into the main part of the building. Caruso was convicted of larceny.
