Facts
Lucindo Carvalho (plaintiff) worked in a yarn factory owned by Decorative Fabrics Co. (defendant). At the end of shifts, employees usually helped each other remove lint from their clothing using an air hose. One day, a fellow employee placed the air hose near Carvalho’s rectum, causing a perforation. Carvalho filed a claim with the Workmen’s Compensation Commission, seeking compensation under the Workmen’s Compensation Act. The commission denied Carvalho’s claim, holding that he was not entitled to compensation because his harm resulted from horseplay and assault by the fellow employee, not from Carvalho’s employment. Carvalho appealed to the Rhode Island Supreme Court.
