Cassiar Mining Corp. v. Superior Court
California Court of Appeal
66 Cal. App. 4th 550, 78 Cal. Rptr. 2d 167 (1998)
Facts
Ten workers (plaintiffs) who sustained asbestos-related lung injuries from inhaling asbestos during their employment sued 162 named defendants who manufactured, distributed, supplied, or installed asbestos products to which the workers were exposed. Cassiar Mining Corporation (Cassiar), a Canadian corporation, and one of the alleged asbestos suppliers, motioned to quash service, contesting personal jurisdiction over it in California because none of its asbestos sales in California were made to any jobsites where the workers claimed they were exposed. The trial court denied the motion, and Cassiar appealed, arguing that jurisdiction is only proper if there is a direct nexus between the claim and the defendant’s forum-state contacts, i.e., the claim must arise out of and not merely be related to those contacts.
