Facts
Employees of the sewerage and water board (the employees) (plaintiffs) went to home of James Galpin (defendant) to inform Galpin that the employees were going to disconnect Galpin’s water if Galpin did not pay his water bill. Galpin threatened to shoot the employees if they turned off the water. Galpin retrieved a shotgun from inside and walked onto the front porch. The employees contended that Galpin pointed the gun at the employees while they prepared to disconnect the water. Galpin asserted that he merely placed the gun across his lap. The employees sued Galpin for assault. The trial court found in favor of the employees, and Galpin appealed to the Louisiana Court of Appeal.
