Facts
Hendrick Humphries (plaintiff), an assistant manager of a Cracker Barrel restaurant, was fired after he complained to managers about the racially based firing of another restaurant employee. Humphries sued CBOCS West, Inc. (CBOCS) (defendant), the owner of the restaurant, alleging that his retaliatory firing had violated 42 U.S.C. § 1981. The district court granted CBOCS’s motion for summary judgment, and the court of appeals reversed and remanded the case for a trial. The United States Supreme Court granted certiorari to determine whether § 1981 encompasses retaliation claims.
