Facts
The Liederman brothers (defendants) were planning to open a restaurant in New York called Television City. CBS, Inc. (plaintiff) operated a production facility in Los Angeles called Television City, the name of which was registered with the Patent and Trademark Office (PTO). Audiences went to the Television City facility to watch shows being produced. The facility had a gift shop where people could buy merchandise and a cafeteria that was for employees only. CBS sued in federal district court, claiming that the name of the restaurant would infringe on the Television City trademark by creating a likelihood of confusion.
