Facts
CBT Flint Partners, LLC (CBT) (plaintiff) sued Return Path, Inc. and Cisco IronPort Systems LLC (IronPort) (defendants) in federal court. In order to respond to CBT’s electronic-discovery (e-discovery) requests, IronPort retained a computer consultant to collect, search, identify, and help produce electronically stored information (ESI) from IronPort’s computer systems. After CBT lost the case, the court clerk taxed the winning parties’ litigation costs against CBT. CBT moved to have the court review the clerk’s assessment. CBT argued that the clerk mischaracterized IronPort’s e-discovery costs as exemplification and copying costs made taxable by 28 U.S.C. § 1920. The court granted CBT’s motion and considered CBT’s argument.
