Facts
A group of employees of Cemex Construction Materials, LLC (Cemex) (defendant) voted against representation by the International Brotherhood of Teamsters (the union) (plaintiff). The union filed a complaint with the National Labor Relations Board (NLRB), alleging that Cemex engaged in unfair labor practices, including threats, interrogation, surveillance, and unlawful prohibitions before, during, and after the election. The union requested that the NLRB overturn the election and order Cemex to collectively bargain. The administrative-law judge (ALJ) found that Cemex violated § 8 of the National Labor Relations Act (the act). The ALJ recommended overturning the election and ordering another election. Cemex appealed.
