Facts
The city of Clayton (the city) approved a proposal by Centene Plaza Redevelopment Corp. (Centene) (plaintiff) to redevelop a one-block area within the city. In conjunction with its approval of the project, the city passed an ordinance declaring the area as blighted. The declaration was based on evidence that the area was an economic liability due to age, obsolescence, inadequate or outmoded design, and physical deterioration of some of the properties. There was no evidence that conditions in the area were harmful to the public health or safety. Mint Properties (Mint) (defendant) and other property owners refused to sell to Centene, and Centene filed a condemnation action. At trial, Mint argued that the ordinance declaring the area blighted was not supported by substantial evidence. The trial court found for Centene, and Mint appealed.
