Facts
The Pacific right whale was one of the most endangered mammals in the world and was among the first species designated by the Endangered Species Act in 1971. However, 34 years later, the National Marine Fisheries Service (service) had still not designated any critical habitat in the Pacific Ocean for right whales. The Center for Biological Diversity (plaintiff) sued and asked for declaratory and injunctive relief against the service for unreasonable delay in making any designation.
