Facts
In order to protect the North Atlantic right whale, the Center for Biological Diversity (center) (plaintiff) sued the National Marine Fisheries Service (service) under the Endangered Species Act. The center believed that the American lobster fishery was harming the whales and sought discovery and admission of extra-record evidence concerning the service’s oversight and authorization of the fishery. Specifically, the center believed that the service was violating its ongoing duty to protect whales and its duty to prevent unauthorized takes of whales. The service responded that the center’s claims must be examined solely on the basis of the current administrative record.
