Facts
Congress enacted the Food Safety Modernization Act to modernize food safety laws and enact new regulations regarding food safety. As part of the act, Congress ordered the Food and Drug Administration to promulgate these new regulations within 18 months. The Food and Drug Administration failed to promulgate the new regulations by the deadline. The Center for Food Safety (plaintiff) sued Margaret Hamburg (defendant), the Food and Drug Administration Commissioner, seeking an order that the Food and Drug Administration promulgate the new regulations as soon as reasonably possible.
