Facts
Central Towers Company (plaintiff) owned a high-rise apartment building in the Borough of Fort Lee (borough) (defendant). The building contained parking spaces that were available for rent to the apartment tenants. A tenant’s parking lease began and terminated on the same date as the tenant’s apartment lease. The borough had a rent-control ordinance that set the permissible level for rent increases. Central Towers increased the rents for the parking spaces above the level permitted by the rent-control ordinance. Subsequently, Central Towers filed suit, contending that the rent-control ordinance did not apply to the rents for the parking spaces. The trial court took the matter under advisement.
