Facts
In 1998, Heather Seslar (plaintiff) underwent a sterilization procedure performed by Dr. Kenneth Chaffee (defendant). Seslar had previously given birth to four children and did not wish to become pregnant again. Nevertheless, after the supposed sterilization procedure, Seslar became pregnant again and delivered a healthy baby. In 2000, Seslar sued Chaffee alleging Chaffee’s medical negligence had caused her unwanted pregnancy. Seslar sought to obtain the future expenses of raising her child through college. Chaffee filed a motion for an order limiting the amount of recoverable damages and for a finding that childrearing costs were unavailable as a matter of law. The trial court denied Chaffee’s motion, and Chaffee appealed.
