Chalmers v. Metropolitan Life Insurance Co.
Michigan Court of Appeals
86 Mich. App. 25, 272 N.W.2d 188 (1978)
- Written by Sheryl McGrath, JD
Facts
Metropolitan Life Insurance Co. (Metropolitan) (defendant) issued an employee group life-insurance policy to Chalmers (plaintiff), who was an airplane pilot for General Motors Corporation. The policy provided disability benefits if the employee became totally disabled and unable to work in any job for which the employee was reasonably qualified. Chalmers had a heart attack and as a result, he lost his pilot’s license. Chalmers submitted a claim to Metropolitan for disability benefits. Metropolitan denied the claim, asserting that Chalmers could work in other aviation industry jobs that he had before becoming a pilot. Chalmers sued Metropolitan for benefits. The trial court found that Chalmers was totally disabled within the meaning of the policy and entered partial summary judgment in favor of Chalmers. Metropolitan appealed.
