Facts
A landlord (defendant) served his tenant (plaintiff) with a notice to quit the tenancy a day after the tenant was subpoenaed to give testimony against the landlord in another matter. The tenant then sued the landlord for contempt of court and alleged that the landlord served the notice to quit to punish the tenant for the tenant’s testimony against the landlord. The jury returned a verdict for the tenant and awarded damages to the tenant. The landlord appealed.
