Facts
Morris Chapsky (plaintiff) married a young woman to the disapproval of his parents. Chapsky’s parents subsequently disowned him, and he found himself in financial constraints. During this time, Chapsky’s wife bore a daughter. Following the birth, Chapsky’s wife was not in good health. As a result, the wife’s sister, Mrs. Wood (defendant), stepped in to help take care of the child. At some point, Chapsky and the mother gifted custody of the child to Mrs. Wood. The child remained in Mrs. Wood’s care and custody for five and one-half years before Chapsky brought a petition for the return of possession of the minor child. Wood opposed the petition.
