Chemcast Corp. v. Arco Industries Corp.
Court of Appeals for the Federal Circuit
913 F.2d 923, 16 USPQ2d 1033 (1990)
- Written by Craig Conway, LLM
Facts
Chemcast (plaintiff) sued Arco (defendant) for infringement of the ‘879 patent, which claimed a grommet, a type of plug designed to seal an opening in, among other things, a sheet metal panel. Arco counterclaimed that the ‘879 patent was invalid for failure to disclose the best mode under 35 U.S.C. §112. The district court held that Chemcast failed to disclose the best mode and invalidated the patent. Chemcast appealed.
