Facts
Cherry (plaintiff) was denied a gasoline credit card by Amoco Oil Co. (defendant). One of Amoco’s stated reasons for the denial was “our credit experience in your immediate geographical area.” Cherry was White, but the residents of her neighborhood were predominately Black. Cherry sued Amoco for racial discrimination under the Equal Credit Opportunity Act. Amoco moved to dismiss Cherry’s claim because she did not have standing to sue, specifically because she was a White woman making a claim of racial discrimination.
