Facts
Craigslist, Inc. (defendant) operated a website that was accessed by third parties seeking to buy, sell, or rent housing. The third parties were allowed to post housing advertisements on Craigslist’s website. A number of the rental-housing advertisements expressed preferences for tenants of a particular race, sex, or religion. The Chicago Lawyers’ Committee for Civil Rights under the Law, Inc. (plaintiff) (the committee), a non-profit organization, brought suit against Craigslist, contending that it violated the Fair Housing Act (FHA). Craigslist argued that the committee’s FHA claim was barred by § 230 of the Communications Decency Act (CDA). Later, Craigslist filed a motion for judgment on the pleadings. The district court took the motion under advisement.
