The Illinois Environmental Protection Act (EPA) subjected baseball, football, and soccer sporting events to nighttime-noise-emission regulations if they occurred at night in a city with more than 1,000,000 inhabitants in a stadium in which nighttime events were not played prior to July 1, 1982. A Chicago ordinance prohibited athletic contests between 8:00 p.m. and 8:00 a.m. in stadiums that were not totally enclosed and contained more than 15,000 seats and were located within 500 feet of 100 or more dwelling units. The Chicago National League Ball Club, Inc. (club) (defendant) filed a complaint seeking a declaratory judgment that the EPA and the Chicago ordinance violated the equal-protection and special-legislation clauses of the state constitution. The club alleged that nighttime baseball games at Wrigley Field would violate the EPA and the Chicago ordinance.
