Facts
Louis Chiero (plaintiff) underwent prostate surgery at the Chicago Osteopathic Hospital (the hospital) (defendant). Chiero sued the hospital for medical malpractice, alleging negligence. Chiero hired an expert witness, but in his deposition, the expert testified that Chiero’s doctor met the prevailing standard of care. The trial court granted the hospital’s motion for summary judgment. Chiero appealed, arguing that the court should eliminate the requirement that the proper standard of care be established by experts in the medical community.
