Facts
Children’s Surgical Foundation (plaintiff) hired National Data Corp. (defendant) to handle Children’s billing and data processing. Children’s sued National, claiming that National failed to properly code claims or collect payments, causing Children’s to lose over $6 million. National moved for partial dismissal, arguing that a clause in the relevant contract limited damages to the amount that Children’s paid National for its services. Children’s responded that the contract provision limiting damages was unconscionable.
