Facts
Choctaw Town Square, LLC (Choctaw) (plaintiff) alleged that Kokh Licensee, LLC (Kokh) (defendant) had aired a defamatory television broadcast. To prove that it had incurred special damages because of Kokh’s broadcast, Choctaw presented the testimony of Evans, the sister of Choctaw’s chief executive officer and the president of All-Star Electric, Inc. (All-Star). Evans testified that, although she did not believe Kokh’s defamatory statement, she decided not to hire Choctaw to perform a lucrative contract for All-Star due to her fear that All-Star’s reputation might be tarnished because its customers might believe the defamatory statement. Kokh filed a motion in limine to exclude Evans’s testimony. Kokh also moved for summary judgment, arguing that Choctaw had failed to prove causation. The trial court denied both motions, and Kokh appealed.
