Facts
Wanda Chatham was an employee of the law firm Chorey, Taylor & Feil, P.C. (Chorey Taylor) (defendants). Chatham had agreed to work for Vincent, Berg, Stalzer & Menendez, P.C. (Vincent Berg) (defendant), a new law firm about to be opened by some of Chorey Taylor’s attorneys. Chatham was asked by a fellow employee to deliver a check for telephone service for Vincent Berg and was making the delivery when her car struck another car being driven by Dannice Clark (plaintiff). Clark was injured in the collision and filed a personal-injury action against Chatham, Vincent Berg, and Chorey Taylor. Summary judgment was granted in favor of Vincent Berg and Chorey Taylor. Clark appealed the judgment in favor of Chorey Taylor. The court of appeals reversed after concluding that a factfinder should determine whether Chatham was acting within the scope of employment when the collision occurred. The Georgia Supreme Court granted Chorey Taylor’s petition for a writ of certiorari.
