Facts
Andy Chrissikos (plaintiff) paid to purchase a house, which he instructed the sellers to deed to his son, Theo, and his daughter-in-law, Sophia Chrissikos (defendant). In return, the couple gave Andy an unsecured promissory note for the purchase money. Theo and Sophia later defaulted on the note. When Sophia filed for divorce, Andy intervened in the action. The trial court ordered Theo and Sophia’s house to be sold in order to make up the unpaid balance on the promissory note. Sophia appealed to the Texas Court of Appeals.
