Facts
R. Wayne Galloway (defendant) built a home using architectural plans protected by a copyright owned by Christopher Phelps & Associates, LLC (Phelps) (plaintiff). Galloway did not obtain a license or other permission to use Phelps’s architectural plans, and Phelps ultimately filed suit for copyright infringement. After the trial, a jury awarded Phelps $20,000 in damages, but the court denied a request for injunctive relief against future sale or leasing of Galloway’s property. Phelps appealed the denial of the injunction.
