Facts
Cinnamon Hills Youth Crisis Center, Inc. (Cinnamon) (plaintiff) operated a residential treatment facility for minors with mental and emotional disorders. Cinnamon wanted to open a program allowing students to live in a separate facility with more autonomy to prepare for reentry into society. Cinnamon sought a zoning variance allowing it to host the program on the top floor of a motel it owned in Saint George City (the city) (defendant). The city denied the variance, citing two zoning regulations, one limiting motel stays to 29 days and another prohibiting residential use of buildings in designated commercial zones. The city had previously granted exceptions to the 29-day limit only for emergency personnel, law enforcement, and business caretakers. Cinnamon sued the city, alleging unlawful discrimination against the disabled. The court granted the city’s summary-judgment motion, and Cinnamon appealed.
