Facts
Frank Cinquanta (plaintiff) owed money to A. N. Burdett (defendant). In a heated verbal exchange, Burdett called Cinquanta a “crook” and a “deadbeat.” Cinquanta brought suit against Burdett on a claim of slander per se. Burdett moved to dismiss the suit, and the trial court granted Burdett’s motion. Cinquanta appealed. The Colorado Supreme Court granted certiorari.
