Facts
Cities Service Company (defendant) operated a phosphate rock mine, and a dam broke in one of its settling ponds, spilling one billion gallons of phosphate slime into a creek and river, killing countless fish and causing other damage. The State of Florida (plaintiff) sued Cities Service, seeking injunctive relief as well as compensatory and punitive damages for harm caused by the dam break. Cities Service filed an interlocutory appeal after a partial summary judgment was entered in favor of the state of Florida.
