Facts
A heated exchange occurred between the Citizens Coal Council (CCC) (plaintiff) and intervenor National Mining Association (NMA) (defendant) as to whether the NMA was authorized to file a statement of material facts pursuant to local rule and whether the district court had granted a motion filed by the CCC for leave to file supplemental authority. The parties agreed that all facts relevant to the case were in the administrative record.
