Facts
Ernst Zündel (defendant) lived in Canada during the 1990s. On a website called the Zundelsite, Zündel posted numerous materials expressing doubt that the Holocaust occurred and accusing Jewish people of fabricating the event for personal gain. Jewish Holocaust survivor Sabina Citron and the Mayor’s Committee on Community and Race Relations (plaintiffs) filed complaints against Zündel with the Canadian Human Rights Commission, alleging that Zündel’s website communications incited hatred or contempt against Jewish people in violation of the Canadian Human Rights Act. The act prohibited hateful telephonic messages but had not yet been extended to cover internet communications. The tribunal was called on to decide whether Zündel’s hateful messages, disseminated via the internet, were prohibited under the act.
