Facts
When the City and Borough of Sitka, Alaska (defendant) became a municipality, its charter included a section that required adopting a municipal code with provisions for “recognizing employee organizations.” Sitka enacted a personnel-policy ordinance that defined the structure of an employees’ negotiating committee but gave municipal employees the opportunity to elect a department representative. Sitka refused to recognize the International Brotherhood of Electrical Workers, Local Union 1547 (IBEW) (plaintiff) as the bargaining agent for Sitka electrical-department employees. IBEW sued challenging the ordinance as invalid, claiming the charter required Sitka to recognize IBEW as the bargaining agent for the electrical department instead. The trial court ruled for IBEW. Sitka appealed.
