Facts
Purdue Pharma L.P. (Purdue) (defendant) owned Walgreens, the largest pharmacy chain in the City and County of San Francisco (the city) (plaintiff). From 2006 to 2020, Walgreens dispensed opioid prescriptions in the city without allowing its pharmacists enough time or resources to perform the due diligence required by the Controlled Substances Act (CSA). Further, an increasing number of individuals in the city died from opioid overdoses during that time, straining the city’s hospitals and forcing public spaces to close. The city brought a public-nuisance claim against Purdue for its contribution to the opioid epidemic in the city. The district court took the matter under advisement.
