Facts
The City of Burbank (defendant) passed an ordinance prohibiting any jet departures from the Hollywood-Burbank Airport between the hours of 11:00 p.m. and 7:00 a.m. Lockheed Air Terminal, Inc. (plaintiff) sued to enjoin the ordinance, arguing that the ordinance (1) was preempted by federal law and (2) violated the Commerce Clause of the United States Constitution because the ordinance placed an undue burden on interstate commerce. The district court and court of appeals both found that the ordinance was invalid. The case was appealed to the United States Supreme Court.
