Facts

Charles Firster (plaintiff) acquired title sight unseen to lakefront property in 1946. In 1956, Firster filed suit for an injunction for the City of Eustis (defendant) to remove boathouses and other structures that inhibited his riparian right to an uninhibited view of the lake. The city’s structures were built in 1921, and the city paid to maintain them and leased them to other parties. In 1954, the city built an additional boathouse. The trial court granted the injunction requiring the city to remove the buildings. The city appealed to the Florida District Court of Appeal, Second District.
