City of Franklin v. Badger Ford Truck Sales, Inc.
Supreme Court of Wisconsin
207 N.W.2d 866 (1973)
- Written by Sean Carroll, JD
Facts
The City of Franklin (Franklin) (plaintiff) bought a fire truck from Badger Ford Truck Sales, Inc. (Badger) (defendant). The fire truck’s wheel and chassis were assembled by Ford (defendant). The fire truck’s wheels were manufactured by Gunite (defendant). The fire truck had a defective wheel and tipped over as a result, causing damage. Franklin brought a products-liability suit based on strict liability against Badger, Ford, and Gunite. Ford and Gunite claimed that because they manufactured only component parts of the fire truck, they should not be subject to strict liability.
