Facts
Lawyers employed with the city of Newark in its office of corporation counsel voted to join a union, the Association of Government Attorneys (the union) (defendants). The union was certified by the Public Employment Relations Commission (the commission). The city of Newark (the city) (plaintiff) appealed the decision, arguing that the commission’s ruling was in error on the ground that the unionization of lawyers whose employment entails representing the city in a legal capacity was in conflict with the Rules of Professional Conduct, New Jersey state law prohibiting supervisors from unionizing, and the Supreme Court’s exclusive jurisdiction to regulate the practice of law.
