Facts

A petition was filed with an Arizona county board of supervisors (the county board) (defendant) to organize a special irrigation district known as the McDowell Mountain Irrigation & Drainage District (the district) (defendant). The district consisted of 11,420 acres located in the county and in six miles of the City of Scottsdale (plaintiff). The petitioners’ primary intent in organizing the district was to develop a planned urban community. The planned community would have certain needs for water, such as for lawns. The county board granted the petition, allowing the district’s organization. In court, Scottsdale challenged the petition and argued that the district was invalidly organized and not for the primary purpose of land irrigation. The trial court granted the county board’s motion to dismiss. Scottsdale appealed.
