Facts
The water and sewer system in the city of Texarkana (the city) (defendant) was operated by the city. The city provided water and sewer service to its residents and also to nonresidents. However, the city had an ordinance that required nonresidents to pay a higher rate for water and sewer service than residents. The city did not provide any justification for the difference in rates. A group of nonresidents (plaintiffs) brought suit, contending that the ordinance was void. The trial court ruled in favor of the city. The court of appeals reversed. The city appealed.
