Facts
In 1997, residents of the unincorporated areas called Tortolita and Casas Adobes in Pima County (county) (defendant) petitioned the Division of Elections for incorporation. A.R.S. § 9-101.01(B) required the consent of the voters in the contiguous areas—Marana, Oro Valley, and Tucson (plaintiff)—to vote to approve the incorporation. The voters did not approve the incorporation. The superior court held that A.R.S. § 9-101.01(B) was constitutional.
