Claflin v. Claflin
Massachusetts Supreme Judicial Court
20 N.E. 454 (1889)
- Written by Sean Carroll, JD
Facts
Wilbur Claflin’s will left one-third of his estate in a trust to his son, Adelbert Claflin (plaintiff). The will stated that the trustees (defendants) were to pay Adelbert $10,000 when he turned 21, $10,000 when he turned 25, and the balance of his portion of the estate when he turned 30. After Wilbur’s death, the trustee paid Adelbert $10,000 when he turned 21. Prior to his twenty-fifth birthday, Adelbert petitioned the court to require the trustees to pay him the balance of his portion of the estate. Adelbert argued that the delayed payments were void.
