Facts
Claire (plaintiff) filed a lawsuit against several corporations (defendants). Claire alleged an ownership interest of approximately one-third in each of the corporations, alleged that illegal or fraudulent acts were being committed, and alleged that corporate assets were being wasted. Claire sought a judicial order dissolving the corporations. Claire submitted affidavits that showed a number of illegal practices, including watering down alcoholic beverages and concealing cash transactions. However, Claire was deposed and admitted to taking money from the corporations’ cash registers, taking cash from off-the-book sales, and taking home food and liquor from the corporations.
