Facts
Nick Roccanova (defendant) coerced Natalie Clark (plaintiff) into recording and sending him pornographic videos of herself by threatening to withhold his friendship if she refused. Both Roccanova and Clark were 14 years old at the time the videos were made and transmitted. After Clark sent Roccanova the demanded pornographic video content, Roccanova shared the videos of Clark across state lines via the internet. Clark sued Roccanova in federal court for possession and interstate distribution of child pornography. Roccanova moved to dismiss, arguing that (1) the statutes did not apply to him because he was a minor; and (2) in pari delicto barred Clark’s recovery because she was equally culpable for recording the child-pornography video of herself in the first place.
